3C- The law and regulations

The Race Relations Act was created and put in the UK by the parliament of the united kingdom. To stop discrimination on the grounds of race. This act stops people being prejudice to others for race, colour, nationality, ethnic and natural origin.  This helps many people live free in this country without being attract because of who and what they are.  
       There are many reasons how this act relates and comes in contact with the T.V and film industry. When creating any different programme and film to air on a certain channel or cinema, the movie has to go through the act to be allowed to be shown to the public. If the film or programme does not follow the act and disobeys the rules of being fair to every race, nationality or ethnic background then people will complain, they will feel like they have been attacked because of the person they are. This will end of the movie or programme being banned and the prosecution of theT.V company who did not follow the act.  Also in the industry, the employment of the workers should be fair, hiring staff with different faces and colours and not sticking to members of one ethnic group or skin colour.
         This is an important law to follow in and out of the film and T.V industry, this creates a better living for all races in the UK as well as fairness to all people living in the UK. Within the film industry, following this law helps a company target out all different target audiences, this creates more viewers and more income for there company. It also shows that this certain channel is fair and is seen as global to the audience they are trying to reach.

The Broadcasting act was also created and brought into the UK rules by the UK parliament. This was brought in to create a legal framework on the electric communication meaning that there are going to have a formal structure of T.V and radio, making sure that they follow the different regulations ( like not involving illegal things in the programmes.)
           It relates to the T.V and film industry because they need to follow this act to make sure them follow there regulations and not include anything seen as unsuitable in there films and programmes. If the do something wrong which is part of their rules and regulations then some type of prosecution will happen. Without the Broadcasting act and this set framework then most electric communications (T.V and radio) they would not be following their rules and regulations before airing a programme.
           This is an important law because it makes sure that all these different types of media communications stay in a certain framework that stops them going over their rules and regulations. Without this law, many programmes will be aired that are seen as inappropriate to certain viewers and viewing rating will go down and so has their income.

The obscene publications act was also present the england and wales, this act determines what can be shown in Britain in different types of communications around Britain. It sort out different public stories it can share, and what different information that can be given to the public.
              This links in very well with the T.V and film industry, only being allowed to show certain stories and information on their different programmes and films, if the obscene publications act do not allow certain things to be shown then they are not allowed to shown on different places to the public.
               This is important because some information are not allowed to be shown to the general public because of it being part of the army information or images and information being to distressing for viewers and is not allowed to be shown because of the this.

British board of film classification, is a company with a wide range of people who watch different T.V and films that are made to create a certain age certificate for them, the 'BBFC' would rather run an independent company then rule under the government. They have been put together to give certain age certificates to different movies to protect the younger audience from seeing violence and sex scenes in these movies. There main aims are to protect the public from any harm or risk that might come from different movies, to empower the public from making different choices, and to protect children from anything bad that can cause distress and harm to children watching.
          They are very important, and a key feature in the UK's T.V and film industry, this is because when sending a film to the cinema, many things have to be looked at before showing it to the public if there is anything like violence, weapons or sex scenes in a movie it has to be detected and announced before the start of the movie. A high certificate also goes on to stop any younger viewers from seeing things that are to distressing to them.  Making sure in cinemas that no one below the certificate age of the film gets in.

Ofcom are a group of people in a company made up of many different people, for example their are NoN- executive chairman, executive directors (including the chief executive), and non-executive directors. These are the main people who deal with the main aim of the company.
            These people as well as others that work in the company focus on and see if certain adverts are suitable to show to the public, seeing if any of the advert involve something that might be seen as disrespecting fro a viewer or might be misleading a viewer and giving false information about the product.
        There main aim is to take down and advert that are seen to breaking the rues of creating an advert. showing things that are seen as wrong to viewers, like being racist to a certain age, gender or colour. Making sure that all advert that they look at are following all the rules and regulations, also taming in complaints from the public, which helps with there findings of adverts which are not acceptable.

The main thing i have been interested in during my research of the different health and safety polices and the different equality polices, is the amount of information that the different T.V websites have on their workers and their backgrounds. The one I focused on the most in the BBC, they make sure that every member of the crew is treated fairly, they even recored the religion and race of their workers making sure they have a wide range of each. I found this interesting because, it shows that they are interested in there workers and they like to employe people from many different backgrounds.
     


3B- Employment legislation and Employee rights


There are many different health and safety issues and regulations in many different T.V industries and companies. The main TV Company I am going to look through is the BBC looking at their health and safety policy. There are many different sections that the health and safety fall under. The first one talks about reporting:
Accident/incident reporting
Under this heading it gives the reader all the explications on how to report in an accident. The person that has had an injury should contact the BBC ORM straight away so a report can be written.
The serious accidents our;
-‘A member of the public taken to hospital as a result of BBC work activities’

-‘An absence from work of more than three days due to a work-related accident’

-‘Fractures, dislocations or amputations’;

-‘Loss of sight or eye damage’

 And many others, safety for their cast and crew is very important knowing that the BBC will help them and understand their situation. Another healthy and safety policy is freelancers.
The BBC explains that freelances are usually not up-to-date or aware of the BBC’s health and safety policies, saying that if they are leading groups and talking and teaching cast and crew they should have their knowledge about health and safety. This information is important for the people in the industry because they know what kind of injury they have to report, what injures they can get there company involved with.

There are many equal opportunities in the BBC, the BBC explain that the more diverse the workforce the better they are able to connect with an audience.  The main polices they have for their workforce are, to create a working environment that will help everyone and will help the crew feel comfortable when working. Having the right equipment for workers who are disabled or need other working areas.
They value and respect all of their crew and the work they put in to crate the BBC, and make sure they are treated fair within the workspace and not a group or an individual is unlawfully disadvantaged.
When looking in more detail of the different equal opportunities in the BBC they focus on many different areas of there crew like religion and disability. Giving different information about how much of the workforce is a certain religion or has a certain disability and explaining  what they do to make the workplace fair and right for every cast and crew member. 


BBC have different rules and equality polices up on there website that change every month, this is to make sure the regulations are up to date with the different workers, its also there to fit with the differnet changers within the tv and film indusrty, and the changes in the company itself.

This law was brought into the uk to stop discrimination of different age groups, it came into force on the 1st of october 2006. This is uselful for workers in different companys to have this law to have a good chance at a job then someone older or younger then themself . It also stops other workers excluding workers from different jobs or different postions in the company because of them being too young or old.

The emplyment rights in the BBC are the same as otheres in other companies, everyone in the workspace showul be treated farlie without them being discrimnated for there colour, race, gender and so on. Workers should be given the right pay when working, above minumin wage which. They should be treated wiht respect when in the workplace, and be given breakes when needed, which is at certin point at work for different types of jobs and workers.

The Trade union i started looking into was BECTU which is a trade union media and entertainment. Belonging to a trade union there are many advantages for exmaple if anything goes wrong withing your worplace that you dont like or find unfair you can go to the trade union, they can help you when in situations like money or being treated unfarlie at a workplace. There are many different trade unions for different jobs, thses are important because they are seen as a voice to mant workers that are getten treated unfairly in there chosen jobs. Trade unions can stop this by starting strikes for the jobs the voice for.

Intellectual property is a concept refers from creations of the mind for which exclusive rights are recgonised this means the owners are granted certin rights, this is different then copyright this is because copyright is when you use someone elses work, for example if a famous artist creates a song, no one else can use this song without the pimmison of the artist. Intellectual property is different, this is when that the certin thing that has been created like a new discovery, the owner has certin rights but it still can be used by certin people. Each type of protection has its advantages, using copyright stops people from taking your idea and making in there own and putting it in other peoples work. Trademarks seprate themself from other brands, a lable showing this trademark can be found on lables and packaging. copyright can be put in use when you create a peice like a song, when this song is copyrighted then no one without your permmison can use this song, if they do there peice can be taken down and can be finned. Trademarks can be used on different logos, for example the nick tick has got a small R to show that it is trademarked meaning no one can use the logo shown.
